Frequently Asked Questions
As soon as you hire an employee and become an employer you have legal duties under auto-enrolment to consider. It's important you know what you need to do from day one, so before hiring an employee, speak to your accountant, or seek professional help so you know what to do.
A declaration of compliance is a form to The Pensions Regulator letting them know how you have met your legal duties under auto-enrolment. The Pensions Regulator will send you a letter telling you to complete a declaration of compliance, and you'll need the letter code to complete your declaration of compliance.
You must complete a declaration of compliance within five months of your 'duties start date' - this is the date that you hire your first employee. If you don't meet this deadline, you may be fined.
When the Pensions Act 2008 was introduced it became mandatory for employers in the UK to put eligible employees into a workplace pension scheme.
Employers must assess all employees to establish whether they should be auto-enrolled. Whether an employee is eligible will depend on their age and how much they earn. You must assess all employees, including those who are temporary, and have variable pay. You may need to seek additional help for these employees when you are assessing them.
